Terms of Service

1. Who you are contracting with

Tincograph is operated by Tincograph (sole trader, registration pending), based in Germany. Full identification details are on the imprint page.

Company registration is not complete. The operating entity, its legal form and its registered address all need to be fixed before these terms can bind anyone, and the imprint must match the register exactly.

2. The service

Tincograph provides a set of software tools that share one account: an AI workspace, the Nova browser and terminal, a camera link between your own devices, and — when released — a video editor and gallery. Some parts run on your own hardware and some run on our servers. Which parts you may use is determined by your plan.

We describe features honestly on this website, including which ones are unreleased. Nothing on the site is a promise that an unreleased feature will ship, or ship by a particular date.

3. Your account

You need an account to use anything that runs on our servers. You must give a working email address, keep your credentials secure, and be at least 13 years old, or older if the law where you live requires it.

The minimum age depends on jurisdiction (GDPR allows member states to set 13–16 for information society services; Germany sets 16). Confirm the number and whether parental consent handling is required.

You are responsible for activity under your account. Tell us atsupport@tincograph.com if you believe it has been used without your permission.

4. Plans, credits and payment

Paid plans are billed in advance, monthly or annually. Credits included with a plan reset each billing period and do not roll over. Credits are spent only on work that runs on our servers; features that run on your own device do not consume them.

If you cancel, you keep access until the end of the period you have already paid for, after which your account reverts to the free plan. We do not delete your data because you stopped paying.

Refund policy, statutory withdrawal rights for EU consumers (14-day cooling-off and the conditions under which it is waived for digital content), VAT/OSS handling, and the merchant of record's role all need drafting properly.

5. Acceptable use

Do not use Tincograph to break the law, to infringe someone else's rights, to attack or overload our systems or anyone else's, or to generate material that sexualises children or incites violence. Do not resell access, share one account between people who are not you, or attempt to bypass credit limits.

We may suspend an account that is causing harm or costing us money abnormally, and we will tell you why when we do.

6. Your content

Your content is yours. You grant us only the licence we need to operate the service for you: storing it, transmitting it between your devices, and processing it to produce the output you asked for. We do not use your content to train models.

Confirm the wording of the licence grant, and whether any downstream model provider you route to with your own key has terms that conflict with the "no training" statement we make here.

7. Third-party model providers

If you configure your own model provider, your prompts go directly from your browser to that provider under their terms, not ours. Your API key is stored in your browser and is never sent to us. If you use included credits instead, we route the request on your behalf to providers listed in our privacy policy.

8. Availability

We aim to keep the service available but do not promise a specific uptime percentage. Features marked beta or unreleased may change or be withdrawn. Local-only features are designed to keep working when our servers cannot be reached.

9. Termination

You can delete your account at any time from your account page. Deletion takes effect after a 14-day grace period, during which signing back in cancels it. We may terminate an account for a serious or repeated breach of these terms, with notice where it is reasonable to give it.

10. Liability

The entire liability section needs professional drafting: limitation and exclusion clauses valid under German law differ substantially for consumers and businesses, and an unenforceable clause is worse than none.

11. Changes

We may update these terms. If a change materially affects your rights we will tell you by email before it takes effect, and continuing to use the service afterwards means you accept it.

12. Law and jurisdiction

Governing law, venue, and the mandatory carve-outs for consumers under EU law need to be set by a lawyer, not assumed.
